1. About these Terms
These Terms of Use ("Terms") are an agreement between you and Haug Enterprises, LLC, a Florida limited liability company doing business as Revenx and Federal Pension Advisors, which operates the Federal Employee Advisor Network and Federal Retirement Planner brands ("we," "us," "our"). They govern your use of:
- the Federal Retirement Planner mobile app (shown on your home screen as "Fed Planner") on Android and iOS (the "App");
- our websites, including federalpensionadvisors.com and the consumer pages at advise.revenx.com, and our online questionnaires, report pages and booking pages; and
- the estimates, reports, reminders, document tools and related services we provide through them (together with the App, the "Services").
By creating an account, ticking a box that says you agree to these Terms, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Our Privacy Policy at https://www.federalpensionadvisors.com/privacy-policy explains how we collect, use and disclose personal information. It is part of these Terms. The consent you give when you request a full report (your "Contact Consent") governs how we and independent professionals may contact you. Section 18 contains a dispute-resolution clause that requires individual arbitration and waives class actions and jury trials, unless you opt out.
2. Eligibility
You may use the Services only if you:
- are at least 18 years old;
- live in the United States; and
- can form a binding contract.
The Services are designed for current and former U.S. federal employees and their families, but anyone who meets these requirements may use them. The Services are not directed to children, and we do not knowingly collect information from anyone under 18.
3. What the Services do
The Services include:
- Instant estimate. A quick illustration of a possible FERS basic annuity, calculated from a few answers. It needs no account.
- Full report. A more detailed illustration of retirement income that may combine your pension, the FERS supplement, Thrift Savings Plan savings and Social Security. You must give us your first name, phone number and email address, and give your Contact Consent. A full report comes with an offer of a free walkthrough call from an independent licensed professional (see Section 6).
- Document tools. You can upload or photograph personnel and pay documents, such as an SF-50 or LES, so that figures can be read from them. You review what was read before anything on your estimate changes.
- Reminders. Optional notifications about your plan and dated federal deadlines, if you turn them on.
- Booking. Links for scheduling a time with a professional, which may be hosted by a third-party scheduling provider.
We may change, add or remove features at any time. We are not required to keep any feature available.
4. Estimates only. Not financial, tax, legal or investment advice.
Everything the Services produce is a general, hypothetical illustration based only on the information you enter and on our understanding of published rules. It is not an official benefit calculation, a guarantee, an offer, or a recommendation.
- Not advice. We are not a registered investment adviser, broker-dealer, insurance agency, law firm or accounting firm. We do not provide financial, investment, insurance, tax or legal advice, and nothing in the Services is a recommendation to buy, sell or hold any product or to make any retirement election.
- Your actual benefits are determined by others. The U.S. Office of Personnel Management (OPM), your employing agency, the Federal Retirement Thrift Investment Board and the Social Security Administration determine your actual benefits from their official records and the law in force when you apply.
- Estimates can be wrong. Results depend on the accuracy and completeness of what you enter, on the assumptions shown with each estimate, and on rules that change. We do not guarantee that any estimate is accurate, complete or current.
- Verify before you act. Before you make any retirement, election, insurance or investment decision, check official sources (for example opm.gov, tsp.gov and ssa.gov) and consider consulting a qualified professional of your own choosing.
5. No government affiliation
We are an independent private company. We are not affiliated with, endorsed by, sponsored by or acting on behalf of OPM, the Thrift Savings Plan, the Federal Retirement Thrift Investment Board, the Social Security Administration, any federal employee union or association, or any other government agency. The word "Federal" in our names describes the audience we serve. It does not mean we have any government connection. Links to government websites are provided for your convenience only.
6. Independent professionals, insurance products and compensation
- Who they are. If you request a full report or book a time, we introduce you to an independent professional (a "Professional"). Professionals are not our employees, agents or partners. They are independent businesses who act on their own behalf and are solely responsible for their own services, advice, statements, licensing and compliance.
- What they may offer. Professionals may be licensed insurance agents and may offer insurance products, such as annuities and life insurance, and possibly other financial products or services.
- How they are paid, and how we are paid. A Professional may earn commissions or other compensation if you buy a product from them. Professionals pay us for marketing and referral services, and that gives us a financial incentive to refer you to them.
- Walkthrough. The walkthrough is free, and you have no obligation to buy anything. You can end a call at any time. We cannot guarantee that a Professional will be available in your area or at a particular time.
- Our role. We do not screen, verify or monitor Professionals' licenses, qualifications or conduct. We do not supervise Professionals, do not endorse or guarantee any Professional, product or recommendation, and are not a party to any agreement between you and a Professional. Your dealings with a Professional are solely between you and that Professional. Before you make any decision, ask them how they are paid and confirm their licensing yourself, for example with your state's insurance department.
- What we share. When you request a full report or book, we share your name, contact details, answers and estimate with the Professional, as described in our Privacy Policy. Once a Professional has your information, they keep their own records and are responsible for them under their own privacy practices.
7. Communications
- Contact Consent. How we and Professionals may call and email you is governed by the Contact Consent you gave, which we keep on record. Calls are placed by people. If you book an appointment, any text-message reminders about it are sent only under the consent you give when you book.
- Call recording. Calls with us or with Professionals may be recorded and monitored for quality, training and compliance. If you do not want a call recorded, tell the caller and end the call.
- Opting out. You may withdraw your Contact Consent at any time, by any reasonable means, including telling the caller, replying STOP to a text, using the unsubscribe link in an email, or writing to info@federalpensionadvisors.com. We will honor your request within the time the law requires, and we will ask the Professionals we have referred you to to stop as well. Opting out of marketing does not stop messages you need for your account, such as sign-in codes.
- Electronic communications. You agree that we may give you notices, disclosures and other communications electronically (in the App, by email, or on our websites), and that they satisfy any requirement that they be in writing. You may withdraw this agreement by deleting your account.
- Charges. Your carrier's message and data rates may apply.
8. Your account
- Creating an account. You can sign in with email, Google or Apple. You must give accurate information and keep it up to date. You are responsible for everything that happens under your account and for keeping your sign-in methods secure. Tell us promptly at info@federalpensionadvisors.com if you believe your account has been used without your permission.
- Deleting your account. You can delete your account at any time in the App (Account tab → Delete my account), at https://www.federalpensionadvisors.com/delete-account, or by emailing info@federalpensionadvisors.com from the address on the account. Deletion is permanent. As our Privacy Policy explains, we keep a limited record of your contact consent and opt-outs and a one-way encrypted (hashed) copy of your email address and phone number, so that we can honor your choices and meet our legal obligations. Deleting your account does not delete information a Professional already holds, and you must contact them directly about it.
- Our rights. We may suspend or close your account, or refuse the Services, if you breach these Terms, if we are required to by law, or if we reasonably believe your use creates risk for us, for Professionals or for other people. Where appropriate, and where we are allowed to, we will tell you.
9. Information and documents you provide
- Your responsibility. You are responsible for the information and documents you provide ("Your Content"). Provide only your own information, or information you have the right to provide. Do not upload anyone else's documents without their permission.
- Protect sensitive numbers. Personnel and pay documents may show your Social Security number and account numbers. Cover your Social Security number and any bank account numbers before you upload. We do not need them.
- License to us. You keep ownership of Your Content. You give us a non-exclusive, royalty-free license to host, store, copy, process and display Your Content only as needed to provide, secure and improve the Services, to comply with law, and as described in our Privacy Policy. That includes having our service providers process it for us. For example, we send uploaded documents to an artificial-intelligence service provider (Anthropic) to read the printed figures, and that provider may not use them for its own purposes.
- Machine-read results. Automated reading can make mistakes. Check every figure before you apply it.
- Feedback. If you send us ideas or feedback, we may use them without any obligation to you.
10. Acceptable use
You agree not to:
- use the Services for anyone other than yourself, or on behalf of a business, without our written permission;
- give false information, impersonate anyone, or misrepresent your affiliation with anyone;
- upload malware, or content that is unlawful, infringing or harmful;
- scrape, crawl or harvest data, or use bots, except for search-engine indexing that follows our robots rules;
- reverse engineer, decompile or try to extract the source code of the App or our calculation methods, except where the law expressly allows it;
- probe, test, bypass or interfere with our security, rate limits or access controls;
- use the Services to build a competing product or data set;
- use the Services to send unsolicited communications, or to collect other people's information; or
- use the Services in any way that violates the law or these Terms.
11. Our intellectual property
We and our licensors own the Services, including the software, calculation methods, text, graphics, reports, logos and the names "Federal Retirement Planner," "Fed Planner," "Federal Pension Advisors" and "Federal Employee Advisor Network." Subject to these Terms, we give you a limited, revocable, non-exclusive, non-transferable license to use the Services, and to download and view your own reports, for your personal, non-commercial use. All rights we do not expressly grant are reserved.
12. Third-party services and links
The Services rely on, or link to, services we do not control. Examples include Apple and Google sign-in, app stores, scheduling pages, government websites, and the services Professionals provide. Your use of those services is governed by their own terms and privacy policies. We are not responsible for them.
13. Fees
The Services are currently free. We will tell you before we charge for any feature, and you will not be charged unless you agree.
14. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL ESTIMATES, REPORTS AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. We do not warrant that the Services will be uninterrupted, secure or error-free, that estimates will be accurate, or that any Professional will be available, qualified or suitable for you. We are not responsible for the acts, omissions, advice or products of any Professional. Some jurisdictions do not allow certain warranty disclaimers, so some of these may not apply to you.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- (a) we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost savings, lost benefits, lost data, or losses from retirement, election, insurance or investment decisions, arising from or related to the Services, any estimate, or any Professional, even if we were told they were possible; and
- (b) our total liability for all claims arising from or related to the Services or these Terms will not exceed the greater of US $100 or the amount you paid us in the 12 months before the claim.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, gross negligence or willful misconduct where the law does not allow that limit. New Jersey residents: Sections 14, 15 and 16 apply only to the extent New Jersey law permits.
16. Indemnity
To the extent permitted by law, you will indemnify us and our officers, members, employees and agents against any third-party claim, loss or expense (including reasonable attorneys' fees) that arises from your intentional misuse of the Services or your knowing violation of these Terms or of the law.
17. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms with a new "Last updated" date. For material changes, we will tell you in the App or by email before they take effect. If you keep using the Services after that, you accept the changes. We will not apply changes to the dispute-resolution section to a dispute we already knew about before the change.
18. Dispute resolution: arbitration and class-action waiver
- (a) Informal resolution first. Before starting any proceeding, you and we each agree to send the other a written notice describing the dispute and the relief requested: to info@federalpensionadvisors.com if it is to us, or to your account email if it is to you. We also agree to try in good faith to resolve it for 60 days. Limitation periods are paused during this time.
- (b) Agreement to arbitrate. Except as set out below, any dispute, claim or controversy arising from or relating to these Terms, the Services, or any communication we send you (including claims under the Telephone Consumer Protection Act and similar state laws) will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. The arbitrator decides all issues, except that a court decides disputes about the scope, enforceability or validity of the class-action waiver and the mass-filing provisions.
- (c) Exceptions. Either party may bring an individual claim in small-claims court. Either party may seek an injunction in court for infringement or misuse of intellectual property.
- (d) Fees. We will pay all AAA filing, administration and arbitrator fees for any claim seeking $10,000 or less, unless the arbitrator finds the claim frivolous. The arbitration will take place in the county where you live, or by video or on the documents.
- (e) Class-action and jury waiver. YOU AND WE EACH AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE PROCEEDING. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL. If this waiver is found unenforceable for a claim, that claim will be decided in court and not in arbitration.
- (f) Mass filings. If 25 or more similar demands are filed by or with the help of the same counsel or coordinated group, they will be administered in batches under the AAA's Mass Arbitration Supplementary Rules. Limitation periods are paused while demands wait for a batch.
- (g) 30-day opt-out. You may opt out of this arbitration agreement within 30 days after you first accept these Terms by emailing info@federalpensionadvisors.com with your name, account email and the words "Arbitration Opt-Out." Opting out does not affect any other part of these Terms.
- (h) Courts. Any claim that is not arbitrated under this Section 18 will be resolved in the state or federal courts located in Pinellas County, Florida, and you and we consent to their jurisdiction, except that either party may bring an individual claim in small-claims court where you live.
- (i) Severability. If any part of this Section 18 other than (e) is found unenforceable, the rest remains in effect.
19. Governing law
These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, including the Federal Arbitration Act, without regard to conflict-of-law rules. This does not take away any protection given to you by the mandatory consumer-protection laws of the state where you live.
20. App store terms
20.1 Apple (if you downloaded the App from the Apple App Store)
- (a) Acknowledgement. These Terms are between you and us only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the App and its content. Your use of the App must also comply with the Usage Rules in the Apple Media Services Terms and Conditions. These Terms may not provide usage rules for the App that conflict with those terms.
- (b) Scope of license. Your license to the App is a limited, non-transferable license to use it on Apple-branded products that you own or control, as permitted by the Usage Rules. The App may also be accessed by other accounts associated with you through Family Sharing or volume purchasing.
- (c) Maintenance and support. We are solely responsible for providing any maintenance and support for the App. Apple has no obligation at all to provide maintenance or support services for the App.
- (d) Warranty. We are solely responsible for any product warranties, whether express or implied by law, that are not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation of any kind with respect to the App. Any other claims, losses, liabilities, damages, costs or expenses caused by any failure to conform to a warranty are our sole responsibility, to the extent they are not effectively disclaimed.
- (e) Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your possession or use of it. These include: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.
- (f) Intellectual property. If a third party claims that the App, or your possession and use of it, infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
- (g) Legal compliance. You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- (h) Developer name and address. Questions, complaints or claims about the App should be directed to: Haug Enterprises, LLC, 100 2nd Ave S, Suite 105N #1014, St. Petersburg, FL 33701, info@federalpensionadvisors.com, 727-591-7431.
- (i) Third-party terms. You must comply with applicable third-party terms of agreement when using the App, such as your wireless data service agreement.
- (j) Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
20.2 Google Play
If you downloaded the App from Google Play, you also agree to the Google Play Terms of Service. Between you and us, these Terms govern the App. Google is not responsible for the App or for supporting it.
21. General
- Entire agreement. These Terms, the Privacy Policy and your Contact Consent are the entire agreement between you and us about the Services.
- Severability. Except as stated in Section 18, if any provision is found unenforceable, it will be enforced to the maximum extent possible and the rest remains in effect.
- No waiver. Our failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition or sale of assets, or to an affiliate. In that case, the Privacy Policy explains what happens to personal information.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
- Export. You may not use or export the App in violation of U.S. export laws.
- Survival. Sections 4–6, 9 (license and feedback), 11 and 14–21 survive termination or deletion of your account.
- Headings are for convenience only. "Including" means "including without limitation."
